Strategy Subscription Service Agreement

Welcome to use the strategy subscription service (hereinafter referred to as "subscription service" or "this service"). In order to protect the rights and interests of users (hereinafter referred to as "you"), please read all contents of this Service Agreement (hereinafter referred to as "this Agreement") before using this service, especially the bold part. Minors should be accompanied by their legal guardians.

You are not entitled to use the service unless you have read and agree to all the contents of this Agreement. If you purchase or use this service, you have reached an agreement with BKEX and voluntarily accept all contents of this Agreement.

Article 1 Acceptance and Amendment of Service Agreement

1.1 The contents of this Agreement include the text of this Agreement and various rules that have been published or may be published / updated in the future. All rules are an integral part of this Agreement and have the same legal effect as the text of this Agreement. In case of any conflict between the text of this Agreement and the above rules, the text of this Agreement shall prevail. Unless otherwise explicitly stated, your use of automatic renewal service is subject to this Agreement.

1.2 if this Agreement and related service terms need to be revised due to business development, BKEX will publish it on the official website. You can check the latest version of the terms of this Agreement. After BKEX modifies the above terms, if you do not accept the modified terms, you can choose to terminate the use of the strategy subscription service. If you continue to use the service, you will be deemed to have accepted the modified agreement.

1.3 This service is a fee-based value-added service provided by the platform party for users. Users can use the services specially provided for subscribers only after paying relevant fees to the platform party.

Article 2 Service Description

2.1. Service charges may vary according to different strategies. The specific information is subject to the content on the subscription payment page.

2.2. The platform party has the right to adjust the fee standard at any time according to the actual situation. For any adjustment of the software subscription service fee standard, the platform party will publicize in advance and take effect from the agreed date. The service purchased according to the original tariff standard before the agreed date will not be affected during the purchase period, and there is no need to make up the difference; if the user purchases the software subscription service after the agreed date, the user who purchases the software subscription service shall pay according to the updated tariff standard.

2.3. The subscriber shall confirm the updated and revised terms of service within the publicity period. For the change of service terms and service fee, the subscriber has the right to make the following choices:

• Do not continue to use the subscription service of relevant strategies.
• If the user does not make any behaviour and continues to use the softwaresubscription service, it will be deemed that the user accepts the change of the service terms and service fee.
• If users agree the updated content, the latest service terms of the platform will be provided to the users after the publicity period.

2.3. The sources are different and the strategies will be different. BKEX only provides strategy aggregation and updates strategy signals to users in time. The accuracy of strategy signals will not be guaranteed. Users need to judge the correctness of the strategy signal and then use it, and be responsible for the use results.

Article 3 Subscription Service Opening and Service content

3.1 A registered user of BKEX platform can become a subscriber of relevant strategies if he / she agrees to all the contents of this clause and pays the subscription fee.

3.2 BKEX is responsible for providing you with the inquiry method for the specific conditions of subscription service charges.

3.2 The subscription validity period is calculated from the time when the current strategy subscription service is opened. The specific validity period can be viewed in User Center after logging in to the platform.

3.3 After the expiration of the subscription service, the platform will terminate the subscription service.

3.4 The subscription service can only be opened for the current account of the user who has opened the subscription. The service cannot be shared or transferred between different accounts.

3.5 The subscription is renewed within the validity period of the subscription, and the validity period will be extended on the basis of the original service validity.

3.6 BKEX will not charge you any service fee for opening the service, but BKEX has the right to decide whether to charge or adjust the fee cycle and amount according to the business needs or market changes, and make an announcement on the relevant page.

3.7 The service provided by BKEX to you is only for your use on BKEX platform. Any use of fee-based subscription service to avoid renewal by malicious cracking and other illegal means will constitute a violation of this Agreement. All legal consequences caused by this shall be borne by the actor, and BKEX will investigate the legal responsibility of the actor according to law.

3.8 The platform party has the right to adjust the strategy subscription service content at any time according to the actual situation.

Article 4 Suspension, Interruption and Termination of Services

4.1 Unless otherwise notified and announced by BKEX, the service will be effective for a long time. This Agreement shall come into effect after you choose to accept or use the service until you terminate the service or cancel your subscription payment qualification.

4.2. BKEX has the right to immediately terminate to provide the service for you in any of the following circumstances, and shall not be liable to you or any third party for this:

• Confirmed by the effective legal documents of the state administrative or judicial organs that you have illegal or infringing acts, or BKEX, according to its own judgment, considers that your behavior is suspected of violating the contents of this Agreement or the rules published by BKEX platform from time to time, or suspected of violating the provisions of laws and regulations;
• Your behavior interferes with the normal operation of any part or function of BKEX platform;
• BKEX believes that there is a significant risk in providing you with this service.

4.3 BKEX may choose to suspend, interrupt and terminate the service according to its own business decision. In case of such situation, BKEX will inform you in the form of announcement.

4.4 You have the right to terminate this service in the relevant pages of BKEX platform at any time. After termination, BKEX will stop providing this service to you.

Article 5 Rights and Obligations of Subscribers

5.1. Subscribers should ensure the authenticity of the registration data. Subscribers guarantee that the registration information (including but not limited to the user's name, mobile phone number, etc.) provided by the subscriber is true and effective. Any consequences and responsibilities caused by the untrue registration information of the subscriber shall be borne by the subscriber himself/herself.

5.2. Subscribers have equal rights to subscribe to the software subscription service.

5.3. Subscribers can use the value-added services of relevant strategies within the validity period of payment.

5.4. Subscribers can give priority to online activities organized by the platform party and enjoy corresponding preferential and value-added services.

5.5. Subscribers have the right not to participate in any activities organized by the platform party.

5.6. Subscribers may terminate or cancel the subscription service qualification during the subscription validity period, but the platform will not refund the fees corresponding to the remaining valid subscription period.

Article 6 Rights and Obligations of BKEX Platform

6.1. The platform party has the obligation to ensure the smooth subscription service. In case of technical failure that hinders the provision of subscription service, the platform party shall repair the failure as soon as possible.

6.2. The platform party will notify and announce the subscriber through the subscription opening interface of the software and SMS.

6.3. The platform party shall not bear any responsibility for the interruption or other defects of the subscription service caused by the third party such as force majeure, but will try its best to reduce the loss and impact caused to subscribers.

6.4. The platform party shall not be responsible for the leakage of account and password due to the user's reason. Meanwhile, in order to avoid legal risks caused by the misuse of the software accounts after accounts are stolen, the platform party has the right to take all measures to prevent the third party from operating the user's account without the user's consent, no matter what purpose it is based on and whether the acquisition method is in good faith and legal.

6.5. If subscribers intentionally damages the legitimate rights and interests of the software, the platform party or other users of the platform party in the process of using the subscription service, the platform party has the right to cancel the subscribers’ qualification of the users without any compensation, and reserves the right to further investigate the legal responsibility for the behavior.

Article 7 Others

7.1 Law and dispute resolution: this Agreement shall be governed by the laws of the People's Republic of China and shall exclude the application of all conflict of laws provisions. In case of any dispute, you and BKEX agree to submit the dispute to China International Economic and Trade Arbitration Commission for arbitration in accordance with its current effective arbitration rules. The arbitration award is final and binding on both parties. The arbitration fee shall be borne by the losing party.

7.2 The failure of BKEX to exercise, promptly exercise or fully exercise its rights under this Agreement or in accordance with the law shall not be deemed as a waiver of such rights, nor shall it affect the exercise of such rights by BKEX in the future.
